Like every other service provider, Pongo Holidays has its own Terms and Conditions that Users must agree to before using our service. To make it easier to understand, we have summarized the main points.

These Terms and Conditions are an agreement between You as a User and Pongo Holidays to prevent any misunderstandings in the future. This Agreement is a legally binding contract that includes terms that may limit the User's legal rights and Pongo Holidays' liability to the User, and it shall govern all access to and use of this website. The User hereby agrees, without limitation or alteration, to all the terms and conditions contained herein. By accessing or using the Pongo Holidays website, the User agrees to be bound by these terms and conditions. You, as a User, are fully responsible for your own decisions while accessing services on the Pongo Holidays website. If the User does not agree to these terms and conditions, the User may not use the Pongo Holidays website.

1. DEFINITIONS

  • “Pongo Holidays” is a travel agency company that provides travel planning and booking services, located at Sukorambi, Jember, East Java, Indonesia.
  • "User" shall refer to the individual or entity that visits, accesses, and/or books services through the Pongo Holidays website.
  • “Service” refers to the travel planning, tour package booking, day tours, and other related services provided by Pongo Holidays.
  • “Third-Party Service Provider” refers to our partners such as airlines, hotels, local tour operators, transportation companies, and insurance providers.

2. GENERAL TERMS

PLEASE READ THE ENTIRE TERMS AND CONDITIONS BEFORE ACCESSING OR USING THE SERVICES OF PONGO HOLIDAYS.

These Terms of Use are an agreement between the User (“You” or “Your”) and Pongo Holidays (“We”, “Us”, “Our”), a company duly established and operating legally under the laws of the Republic of Indonesia and domiciled in Jember, Indonesia. These Terms of Use govern your access to and use of our applications, website (e.g., www.pongoholidays.com), content, and products we provide (hereinafter collectively referred to as the "Platform"), as well as the ordering, payment, or use of services available on our Platform ("Services").

By agreeing to these Terms and Conditions, you also agree to any additional Terms and Conditions, including the Terms and Conditions for each Service, and any amendments that are an integral part of these Terms and Conditions.

3. INTELLECTUAL PROPERTY

The User hereby unconditionally agrees that all rights, titles, and interests in the copyright and other intellectual property rights in Pongo Holidays' products and content (including text, images, logos, and videos) belong to Pongo Holidays. The trademarks, logos, designs, and service marks appearing on Pongo Holidays' products are registered marks. Therefore, nothing on the Pongo Holidays Platform grants the User any right to use any form of intellectual property contained therein without express written permission.

4. DESCRIPTION OF RIGHTS AND LIMITATIONS

  • Use of Service: The User may access and use the Pongo Holidays Platform solely for personal, non-commercial purposes to search for information and book travel services.
  • User Restrictions: The User may not:
    • Use the Pongo Holidays Platform for any illegal or unlawful purpose.
    • Extract factual content or other parts of Pongo Holidays' products by any automated means, including but not limited to database scraping or screen scraping.
    • Reverse engineer, decompile, or disassemble the Pongo Holidays Platform, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

5. PERSONAL INFORMATION

The collection, storage, processing, use, and sharing of the User's personal information, such as identity data, contact data, and location data that the User provides when creating an Account, are subject to the Privacy Policy, which is an integral part of these Terms of Use.

6. USER ACCOUNT

A User Account may only be used by the User and cannot be transferred to another person for any reason. Pongo Holidays has the right to refuse to facilitate bookings if Pongo Holidays knows or has sufficient reason to suspect that the User has transferred or allowed the User Account to be used by someone else.

The security and confidentiality of the User Account, including the registered name, email address, registered mobile phone number, and payment details, are entirely the responsibility of the User. All losses and risks arising from the User's negligence in maintaining security and confidentiality are the User's responsibility.

Notify Pongo Holidays immediately upon knowing or suspecting that the User's account has been used without the User's knowledge and consent. Pongo Holidays will take actions we deem necessary against such unauthorized use.

7. USER'S STATEMENT

The User represents and warrants that they are at least 18 (eighteen) years old or are married and not under guardianship or conservatorship, and that the User is legally capable and has the right to bind themselves to these Terms of Use. If the User does not meet these conditions but continues to access or use the Platform or Services, the User represents and warrants that their actions to register, access, or perform other activities have been approved by the User's parent or legal guardian.

The User agrees to access or use the Platform and Services solely for the purposes specified in these Terms of Use and not to misuse or use them for fraudulent purposes, causing inconvenience to others, or any other actions that may be considered to cause harm in any form to other people.

THE USER ACKNOWLEDGES THAT PONGO HOLIDAYS IS A TRAVEL AGENCY COMPANY. PONGO HOLIDAYS ACTS AS AN AGENT FOR THIRD-PARTY SERVICE PROVIDERS SUCH AS AIRLINES, HOTELS, TOUR OPERATORS, AND OTHERS. PONGO HOLIDAYS DOES NOT PROVIDE TRANSPORTATION, ACCOMMODATION, OR OTHER SUCH SERVICES DIRECTLY.

8. USER'S RESPONSIBILITY

The User is fully responsible for the decisions they make to use the Platform and Services. The User must treat Third-Party Service Providers with respect and must not engage in any unlawful, threatening, or harassing behavior when using the Services.

The User is fully responsible for any losses and/or claims arising from the use of the Platform or Services using the User's Account, whether by the User or other parties using your account, in a manner that is contrary to these Terms of Use, the Privacy Policy, or Applicable Law.

9. BOOKING AND PAYMENT

All bookings made through the Pongo Holidays Platform are considered valid upon receipt of payment confirmation. The User agrees to follow the established payment procedures. All prices are subject to change at any time without prior notice, except for bookings that have been confirmed and paid in full.

Cancellations, schedule changes, and refunds are subject to the terms and conditions of each Third-Party Service Provider (airline, hotel, etc.) and the Pongo Holidays cancellation policy applicable to the specific package.

10. TROUBLESHOOTING

If the User experiences issues or problems related to the Services or payments, the User may submit a complaint through the features we provide or by contacting Pongo Holidays directly.

To submit complaints, questions, objections, etc. ("Reports"), the User needs to provide sufficient information, including a summary of the facts, any evidence the User may have, booking numbers, and personal information.

11. LIMITATION OF LIABILITY OF PONGO HOLIDAYS

Pongo Holidays provides the Platform "as is" and we do not represent or warrant that the reliability, timeliness, quality, suitability, or availability of the Platform will meet the User's needs and expectations. Pongo Holidays will not be responsible for any loss or damage caused by the failure or error of Third-Party Service Providers or the User's failure to comply with their terms and conditions.

The Platform may experience limitations, delays, and other problems inherent in the use of the internet and electronic communications. Pongo Holidays is not responsible for any delays, delivery failures, damages, or losses resulting from such problems.

12. FORCE MAJEURE

The Pongo Holidays Platform may be disrupted by events beyond our authority or control (“Force Majeure”), including but not limited to natural disasters, power outages, telecommunication disruptions, government policies, pandemics, and other events. The User hereby agrees to release Pongo Holidays from any and all claims and responsibilities if we are unable to facilitate the Service, either in part or in whole, due to a Force Majeure event.

13. GOVERNING LAW & DISPUTE RESOLUTION

These Terms of Use are governed by the laws of the Republic of Indonesia. Any and all disputes arising from the use of the Application or Services shall be subject to the exclusive jurisdiction of the Jember District Court.

14. MISCELLANEOUS

The User fully understands and agrees that these Terms are an electronic agreement and the User's action of pressing the 'register' button when creating an Account or the 'login' button when logging into a User's Account constitutes the User's active consent to enter into a legally binding agreement with Pongo Holidays.

The User may not transfer their rights based on these Terms of Use without the prior written approval of Pongo Holidays. However, Pongo Holidays may transfer our rights under these Terms of Use to any party at any time without prior approval from or notification to the User.
